These terms and conditions are a binding contract between BSO Real Estate Management, the legal entity that provides services displayed on this web site (the "BSO", "we", "our" or "us") and you ("you" or "your"). These terms and conditions, together with the end user license agreement, if any, on BSO web site and any other documents they expressly incorporate by reference (collectively, the "Terms"), govern your access to and use of this web site, including any content, functionality and services offered on or through the web site (the "Site"), whether as a guest or a registered user. We reserve the right to modify these Terms from time to time, and we will make you aware of material changes to these Terms by visibly posting them on the Site. All changes are effective immediately when we post them and apply to all access to and use of the Site thereafter. For the accuracy, merchantability, fitness for a particular purpose, or non-infringement of any content published or made available through the Site; That the server that makes the Site available is free of viruses or other components that may infect harm, or cause damage to your computer equipment or any other property when you access, browse, process a payment, download from other otherwise use the Site; Regarding the link to the Site hosted by the payment gateway service provider for the processing of credit card payments, and the BSO is not responsible for the accuracy of the content of the Site and their mechanisms for information collection and usage. The customer using the Site who are minor or under the age of 18 shall not register as a user of the Site and shall not transact on or use the Site (age of consent is mentioned as per the applicable law).
If you complete a transaction using our payment gateway service, you will be deemed to have agreed to these terms and conditions. These terms and conditions may be changed without notice, so you should re-read them each time prior to completing your proposed transaction. The service available through the Site is provided by the payment gateway service provider in agreement with BSO. You do not have to be a payment gateway service provider customer to use this service.
The BSO is committed to protecting any personal information you provide directly to us, most especially on the Site. However, the personal information you enter on this payment gateway service (such as names, email address and credit card details) is held by the payment gateway service provider to enable your payment transaction be completed. As the BSO does not hold this personal information, the BSO is not liable in relation to the collection and usage of it, and is not liable for any damage or loss arising in connection with the collection and usage of your personal information. All credit/debit cards details and identifiable information will not be stored, sold, shared, rented or leased to any third parties.
All instructions transmitted by or received from anyone presenting your password or other credentials on the Site are binding to you. You agree that you are solely responsible for all transactions or acts that are validated through use of your password or other credentials, whether or not made with your knowledge or authority. You agree to guard your password or other credentials carefully, with the full awareness that a failure to keep it secure will enable others to engage in transactions through the Site for which you will be legally responsible. The BSO has no liability for transactions initiated under your password without your authorization.
The BSO will only receive the information which enables payment to be made to your service charge account and will not receive any of your credit card information. If your payment is not successfully processed through this payment gateway service due to credit card or any other issues you will remain fully liable to pay any outstanding service charges.
Fees and charges may apply and will be addressed and determined by your card issuer as any credit card transaction carried out on the Site is subject to the arrangement between you and your card issuer. If payment is made using a credit card issued outside of the United Arab Emirates, any currency conversion will be done according to the terms and conditions of your card issuer. The pricing may vary for each services provided.
Fees once paid will not be refunded under any circumstances. Indemnification You understand and agree that you are personally responsible for your behavior on the Site. You agree to indemnify, defend and hold harmless the BSO, its’ subsidiaries, affiliated companies, business partners, licensors, employees, agents, and any third-party information providers to the service from and against all claims, losses, expenses, damages and costs (including, but not limited to, direct, incidental, consequential, exemplary and indirect damages), and reasonable attorneys' fees, resulting from or arising out of your use, misuse, or inability to use the Site, or any violation by you of these Terms.
In order to ensure receiving payment gateway service in a legal and secure way, avoid paying through an intermediary person or by using a credit card, a debit card, and/or any electronic payment means belonging to others and/or without permission and/or unlawfully.
In case of infringement of the above-mentioned and/or complaint by the original owner of the card or electronic payment mean used, the customer (whether a person or an entity) benefiting from the service will be legally liable and punished by imprisonment and fine, or any of the punishments in accordance with the laws of the Dubai International Financial Centre (“DIFC”) concerning combating information technology crimes, without prejudice to the BSO and to the payment gateway service provider right to exercise all the legal remedies and rights available.
These Terms and any dispute or claims arising out of, or in connection with it, its subject matter or formation (including non-contractual disputes or claims) shall be governed by, and construed in accordance with the laws of the DIFC, specifically the Small Claims Tribunal, and the DIFC Courts shall have exclusive jurisdiction in relation to it.
